New Route for Basic Disclosures
A New Basic Disclosure application route has been launched for customers applying for jobs in England and Wales.
From 1st January Disclosure Scotland will no longer provide Basic Disclosure checks for customers in England and Wales. Customers in England and Wales must obtain their Basic Disclosure through the DBS (Disclosure and Barring Service).
What's Changed?
Previously Disclosure Scotland had processed England and Wales Basic Disclosure checks, this ended on 1 January 2018. Employers checking candidates using the Basic Disclosure are required to ensure they process a criminal record check through the appropriate body – DBS or Disclosure Scotland.
It is important that people use the right organisation to obtain their Basic Disclosure Check(s). This will ensure that the correct rehabilitation rules are applied. The rules in England and Wales differ from those in Scotland. If the wrong rules are applied information could appear on a Disclosure Certificate that an employer does not have the right to view. This could lead to legal challenges.
Employers have always been able to ask a prospective employee if they have any current convictions.
A Basic Disclosure is an official document that supports their answer. A Basic Disclosure lets the employer confirm whether an employee has a current criminal conviction or not. The information is taken directly from the Police National Computer and printed on an official
Disclosure certificate from Disclosure Scotland.
The Basic Disclosure contains details of unspent convictions according to the Rehabilitation of Offenders Act 1974 which are held on central police records or will state if there are no such convictions.
