Scottish PVG scheme launch

The end of this month will see the launch of the Scottish Protecting Vulnerable Groups (PVG) scheme. This scheme will introduce two barring lists, the PVG Children and Adults Barred Lists, which will be the Scottish equivalent to the Children and Adults Barred Lists currently administered by the ISA for England, Wales and Northern Ireland.

The PVG scheme will work alongside the checking systems currently in place for the rest of the UK through the Safeguarding Vulnerable Groups Act (2006). This means that an individual who is barred from working with children and/or vulnerable adults in Scotland, will also be barred throughout the rest of the UK. Similarly any individual who is on one or both of the ISA barring lists will also be barred from working with children and/or vulnerable adults in Scotland.

From 28 February, a cross-border protocol will ensure that the ISA and the PVG will work together and will recognise the information contained on each of the barred lists and agree whose jurisdiction takes the lead on particular cases.  This decision will be based on a consideration of issues such as the geography of the incident that triggered the requirement for a barring decision.

If an individual is applying for a CRB check and is found to be barred from working with children or vulnerable adults under the PVG scheme, the information will be disclosed on the CRB certificate, in the ‘Other relevant information disclosed at the Chief Police Officer’s discretion’ box.

Furthermore, if an applicant wishes to raise a Dispute because the ‘Other relevant information disclosed at the Chief Police Officer’s discretion’ box shows that they are included on one or both of the PVG lists, the CRB will process and investigate the Dispute following the standard procedure.
